Read these before you use 2A List. By creating an account, posting a listing, contacting a seller, or simply browsing, you accept them. If you do not accept them, do not use the site.
1. Who we are, and what this agreement is
2A List is operated by [LEGAL ENTITY NAME], a [ENTITY TYPE AND STATE OF FORMATION](“we”, “us”). These terms are an agreement between you and us covering your use of the site.
They take effect on [EFFECTIVE DATE] and remain in force for as long as you use the site. Sections that by their nature should survive — disclaimers, indemnification, limits on liability and dispute resolution — survive the closure of your account.
2. What 2A List is, and what it is not
2A List is a classified advertising venue. Members post listings; other members read them and contact the seller. That is the entire service.
We are not, and never act as, any of the following:
- a firearms dealer, importer or manufacturer
- a broker, agent or representative of any buyer or seller
- a party to any sale, purchase, trade or transfer
- an escrow service, payment processor or shipper
- an inspector, appraiser or authenticator of any item
We never take possession of an item, never handle money between members, and are not present at any transfer. Every agreement is strictly between the buyer and the seller.
3. Eligibility
To use 2A List you must be at least 21 years old, legally permitted to possess firearms where you live, and not a prohibited person under federal, state or local law. You may not use the site on behalf of anyone who is prohibited.
If we have reason to believe you do not meet these requirements we may close your account without notice.
4. Your account
You are responsible for everything done through your account and for keeping your password secure. Tell us promptly if you believe someone else has access to it. One person, one account — do not sell, share or transfer your account.
You may close your account at any time from your account settings.
5. Listings, and what may not be listed
You are responsible for the accuracy and legality of everything you post, including photographs. Listings must describe a real item you actually possess and are entitled to sell.
You may not post anything covered by our prohibited items policy, advertise a transfer that would be unlawful, or use a listing to reach an outcome the law forbids.
We do not pre-screen listings. We may remove any listing, for any reason, at any time.
6. Compliance with firearms law is yours
You are solely responsible for complying with every law that applies to you. That includes federal law, the law of your state, and the law of the other party's state, county and city.
In particular: a transfer of a firearm between residents of different states must go through a licensed dealer (FFL). Do not use this site to arrange otherwise.
Firearms law varies enormously by jurisdiction and changes often. Any advisory notice the site displays — including state-level banners — is a convenience, may be incomplete or out of date, and is not legal advice. Verify the law yourself, or ask a lawyer or a licensed dealer, before you complete anything.
7. Conduct
You agree not to:
- harass, threaten or defraud another member
- impersonate anyone, or misrepresent your affiliation
- scrape, harvest or bulk-collect listings or member information by any automated means
- use member contact details for unsolicited commercial messages
- interfere with the site's operation or attempt to gain unauthorised access to it
8. Your representations to us
Each time you use the site you confirm that:
- everything you have told us is true
- you meet the eligibility requirements in section 3
- you own or have the right to post everything you upload, and it does not infringe anyone's rights
- you will comply with all applicable law in any dealing arising from the site
9. Reporting, moderation and termination
Every listing carries a report link. Reports alleging a prohibited item or an unlawful transfer are triaged ahead of everything else. If you believe a listing describes a crime in progress, contact law enforcement — do not rely on us alone.
We may suspend or terminate any account, and remove any content, at any time and without advance notice. We are not obliged to give a reason.
10. Copyright claims
If you believe material on 2A List infringes your copyright, send a notice to our designated agent, [DESIGNATED DMCA AGENT NAME], at [DMCA AGENT EMAIL] or [MAILING ADDRESS].
Please include:
- identification of the work you say is infringed
- the URL of the material you want removed
- your name, address, telephone number and email
- a statement that you believe in good faith the use is not authorised
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them
- your physical or electronic signature
We remove infringing material and terminate repeat infringers.
11. Your content
You keep ownership of what you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and distribute it for the purpose of operating and promoting 2A List. That licence ends when you delete the content, except for copies retained in backups or required for a legal obligation.
12. Privacy
How we handle your information is set out in our privacy policy. Contact between members happens through the site so that seller email addresses are not published for anyone to collect.
13. Disclaimers
The site is provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not verify members, run background checks, inspect items, or confirm that anyone is who they claim to be. We do not warrant that any listing is accurate, that any item is as described, lawful to own, or lawful to transfer, or that any member will do what they say.
You deal with other members entirely at your own risk. Meet safely, verify what you are buying, and confirm the legality of the transfer before money changes hands.
14. Indemnification
You agree to indemnify and hold harmless [LEGAL ENTITY NAME], its owners, officers and staff from any claim, loss, liability, damage or expense — including reasonable legal fees — arising out of your use of the site, anything you post, your dealings with another member, or your breach of these terms or of any law.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, personal injury, property damage, or any harm arising from the conduct of another member — whether online or in person.
Where liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Listing on 2A List is free, so for most members that amount is nil.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
16. Dispute resolution and binding arbitration
Read this section carefully — it affects your rights. It requires most disputes to be arbitrated individually rather than decided by a judge or jury, and it waives class actions.
If a dispute arises, contact us first at [LEGAL NOTICES EMAIL]. Most things can be sorted out without lawyers, and we ask for 30 days to try.
If that fails, any dispute arising out of or relating to these terms or your use of the site will be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER, e.g. AAA or JAMS] under its rules, seated in [ARBITRATION CITY AND STATE].
Class action waiver. Disputes are brought only in your individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding.
Either party may still bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property.
17. Governing law
These terms are governed by the laws of [GOVERNING LAW STATE], without regard to conflict-of-laws rules. Where a matter is not subject to arbitration, the courts of [GOVERNING LAW STATE] have exclusive jurisdiction.
18. Changes to these terms
We may revise these terms. If a change is material we will make reasonable efforts to flag it on the site. Continuing to use 2A List after a change takes effect means you accept the revised version.
19. Miscellaneous
If any provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor. These terms, together with the policies they reference, are the entire agreement between you and us about the site.
